Is a Stamped Signature or Reproduction of a Signature the Same as an Original Hand Written Signature When It Comes to the Filing and Enforcement of Original Mortgage Documents?


Meaning will the court accept a stamped or reproduction of a signature on a mortgage note as legal and enforceable.

In my opinion No, almost all legal documentation require original signitures, but know I am seeing a transition to paperless documentation in which it is being done digitally which represents your original signiture. It's up to the institution requesting the documents wheather they accept them or not and if in dought seek legal advice.. This is just my opinion.

The mortgage instrument is filed in the Real Estate records, not in any court. The signatures must be original or in some jurisdictions an electronic signature. The only time I've seen a stamp accepted was when a quadraplegic real estate investor was signing documents with a stamp that had been approved by the Recorder of Deeds.

Get a good layers to opine. If it all goes down the tubes and enforcement is necessary, the other guy will have one. I am not a layer and I don't play on TV.

Can't see why someone would skimp on attorney fees when so much more is riding on the document. besides if the attorney is wrong, he/she would have O & E.

I agree with Bryan Taylor.....some court docs can be signed, scanned and filed but you are talking about a financial instrument. I believe it's a whole different ballgame. I hope my meager opinion helps....lol
