We are the makers of a Windows 11 Computer program called Lien Writer, a system that Subcontractors, Material Suppliers, Equipment Lessors and General Contractors use to send claim forms to the Owners, Public Entities, General Contractors and Lenders/Sureties of a job, generally called by us PRELIMINARY NOTICES (also known as Notice to Owners, Notice of Claim, etc., in the various States and Canadian Provinces) to establish the RIGHT to place a lien on the job in the event you are not paid. We like to say this is not a threat to the Owners and General Contractors, but a promise when you are not paid in full.

There are some severe time requirements to serve these notices on the involved parties, from 8 days from the start of a job for Oregon, 20 days from the start of a job in California, to 30 days from the start of a job in Nevada, and 45 days from the start of a job in Texas. If you fail to send out one of these notices within the required time period you make only end up with the right to pursue you customer for payment, and God knows what he has. The Owner or Public Entity (with the surety) is your best bet for collection, and they have learned to take our notices SERIOUSLY.

The process is simple. Using our computer program, you enter the job info, send the notices printed by the computer to the required parties via Certified Mail (generally, only the owner and general contractor) and you are protected. You can also do the required (by state) WAIVER AND RELEASE forms for those clients seeking to be relieved of the claim, once you have CASH in the bank. If your client is past time paying you, you can send a LIEN WARNING NOTICE to the parties (this is usually enough) followed by a MECHANIC'S LIEN, when needed.
