The pro act goes a little far BUT it also protects the independent workers who are now denied some kind of employer coverage for taxes, healthcare and workplace safety. Let's say you are a restaurant and want to have food delivered. You hire a delivery person as an "independent contractor". Do you check this person's car? Do you check their health to make sure your customer gets their food uncontaminated? When that person gets old, after driving for you for 25 years, do you say, "Sorry pal, you are an independent contractor. I'm not responsible for your old age." And you answer, "But years ago I wanted to be on the payroll and you consistently denied me." It goes both ways.
