Lately, I’ve come across more conversations about injury claims tied to properties where the injured party was not an authorized tenant or occupant. In some cases, the individual’s presence on the property was clearly unauthorized, yet the claim still moved forward under premises-liability theories.

What feels unsettled is how responsibility is actually being assessed in these situations. Rather than centering on whether the person had permission to be there, analysis often seems to revolve around issues like property control and upkeep.
