We have segregated the funds into a separate account and transfer the exact amount of payroll, rent etc. into our operating account when we make payments for which the funds can be used to make it easy to trace our use of the funds. As for our accountant, we did consult with her, but, because the CARES act is so new, guidance is constantly evolving, and I have attended numerous Zoom presentations discussing the law and regs, I found I knew more about it than she did.

As some businesses have started to reopen, I’ve seen both customers and business owners/employees disregard safety precautions.  Yesterday, my wife and I went to a memorial service for a person who had died from a heart attack. The family provided an option for those who wished to pay their respects to drive  by and open a car window to talk for a few minutes with a family member. We elected to do so and wore our masks during that exchange.  Although the family member to whom we spoke stayed about 5-6 feet back from the car, neither he nor any other person not in a car was wearing a mask or otherwise observing social distancing.  Since my wife has lost an uncle to Covid-19, we know how deadly this virus is and how terrifyingly quick it can kill. But for most, the dangers are an abstract concept because they have not personally lost friends or family members to Covid-19.

(more) As an attorney, I have not really encountered any opposing counsel operating illegally, although there have been a few whose ethics or judgment I questioned.  When one of my clients comes to me with a problem with a competitor operating illegally, I generally send a cease and desist letter to the competitor with the threat of a civil suit, but never threaten a criminal prosecution since that could constitute extortion.  I leave the decision on whether to file a criminal complaint to my client since my client has actual knowledge of the illegal acts. If necessary, I file the civil suit and may seek injunctive relief as well as civil damages on behalf of my client.
