First... No one should give you legal advice on a public forum, its not confidential, and its not custom. Your questions raise more questions that can't be dealt with in this forum. So these statements are very general. By settlement. You can never be guaranteed a result in court only the lawyer's best guess based on experience and interpretation of the law. Obviously the terms and conditions surrounding the agreement influence the final result... and the political connection of your divorce lawyer will also frequently influence the result. State law also determines whether or not you can have an enforceable contract. Texas generally will enforce a well drafted agreement. If there are children, then the court can still upset an otherwise valid contract for child support. The only way to have "made sure" was to have done so before the divorce. Too little information. What country, what State? For both the location of the business (corporation?) and the domicile of the parties. If you are talking about an agreement you are about to enter into... a good contract/divorce lawyer is what you want, and getting it signed as a final order by the Judge. Most lawyers can get that done... by agreement, settlement. Afterwards, it will be as enforceable as an agreement can get. Divorce courts are generally highly political. Same lawyers in front of the same Judges day by day. Even a fair Judge tends to lean towards someone she knows personally in a close call, and many divorce Judges aren't fair. If you are talking about enforcing an existing agreement, one made before the divorce that you now want to keep... that's a horse of a different color. We don't handle divorce matters. We do on occasion take legal malpractice cases after a divorce lawyer has messed things up. You need a referral to a divorce lawyer in the county where the divorce is or will be pending. If it is a large company then you might need outside counsel to deal with the issues over the divorce lawyer's head.
