Bob Bering
Bering CPA Firm LLC
About Us
We structure our Tax Return pricing to appeal to all tax return types. Most chain store tax preparation companies have HIGHER fees. Our returns typically start at $160. We are very competitive when it comes to our contemporaries in the CPA industry.
How We Got Started
After 10 years of working for other CPA Firms, I decided to see if I can make more money with my own practice. My Firm was started out of the loft in my home (as a part-time practice) and I established an outside office 2 years later.

For the Second Round of PPP, you will need to demonstrate a decline in Quarterly Revenue of 25% or more of 2020 compared to the same quarter in 2019. This means that you will need to have financial statements, so if you summarize your operations annual, you should get to work on financial statements for 2019 and 2020 broken down by quarter. The SBA may use bank statements as an alternative, but this remains to be seen.

60% needs to be used for "payroll" which has a special definition. There are limitations on owner compensation, and given the number of variables that exist, more information would be necessary. On the surface, payroll to your employee that will keep your business alive much longer seems to be a resounding yes, versus not paying the employee and the business dying. Don't spend all the funds until you get a clear plan in place and know where you stand in order to get approved for forgiveness. My Firm can help with this planning.
Chase seems to be a big problem in getting anything funded. I've completed a couple of dozen apps and some are now getting funded. A number of financial institutions were asking for information for the EIDL, which confused the process, but I look for phase 2 to be a much smoother operation.

Nick,
Do you have anyone on payroll (not yourself)?
I would want to confirm that you have filed all of the Business Organization documents, obtained an Employer Identification Number, have an S approval letter on hand, registered as an Employer in your state, and know the worker compensation insurance laws in your state and how they apply to owner employees.
Now for the rest of the story:
You should separate your personal bank account from the business.
In order to determine reasonable compensation for you, it is necessary to first know what your year to date profit is, and I would ask how many other employees do you have on payroll? I then consult various industry ratios to determine your "reasonable amount" of Officer Compensation. Be aware that this amount is not a science and there are many factors that go into the amount that is termed "reasonable".
The 199a deduction is not a straight forward amount. It is limited by several factors including information from both the S Corporation and your Individual Income Tax Return. My Firm is performing tax planning for many clients, as this deduction stands to reduce a business owners tax liability significantly. I do know how to compute this deduction and to maximize it as a part of the aforementioned tax planning.
My Firm also processes payroll and can provide payroll processing no matter where you reside or work.
I would be happy to discuss all of the above and to provide the necessary Income Tax and Payroll planning and preparation services.
Best regards to you....

You should look at IRS Form SS-8, which will help you determine their classification.
Your State Unemployment Insurance laws will have a listing of occupations whereby workers are determined to be "statutory employees" -- contract workers who are covered by State Unemployment Insurance. At the same time, some states provide clarity on workers status as employee versus independent contractor. You should consult this source as well comes to seasonal help, which may address worker classification and the application of the Unemployment insurance laws.
My Firm can also help you with this as we provide Nationwide Payroll Services.

If the FMLA applies to the employer then you have the answer spelled out there from an employee retention / employment status situation. Keep in mind that FMLA is unpaid leave. I would suggest that if possible, enable the employee to work remotely as most employees need the income. I'm a Firm of 3 full time and one part-time employees during the non-filing season part of the year, and have it set up so that my full time employees have a remote solution.
