(more) It is absolutely true that all websites are strongly recommended to be accessible to everyone regardless of disability or impairment. It is not the law, however, in the US. It IS legally required for government websites (Section 508) and most educational websites are compliant since they accept federal funds. No US Administration has enforced or made into law making the ADA (Americans with Disabilities Act) Title III apply to websites. (The one attempt never passed the House because it caused more hardship for disabled persons.) The case with Dominos was simply that the Supreme Court refused to hear the case and sent it back to the 9th Circuit Court, which ruled in favor of the plaintiff on ethical grounds. It is important for website owners to be aware that they must hire experienced staff trained in accessibility compliance. Every country has their own guidelines and laws, as does each state in the USA.  There are law firms and unscrupulous people chasing down websites to sue and several states beginning to fight this practice. All PDF's must be accessible. All shopping carts. Images. Web pages should not require a mouse to use them.  YouTube video. Podcasts. Mobile apps. Accessibility compliance (WCAG2.1 A, AA, AAA) guidelines are free to get online and free to learn (it takes awhile.)  The guidelines are there for people who wear glasses, suffer from a health issue that causes hand tremors, are dyslexic, slow readers and have cognitive impairments. Most lawsuits are from blind users who use assistive devices. This is going to grow since the technology is making the web more available to everyone in a variety of ways. I'm certified in ADA accessibility law and am a consultant and advocate in the field, should anyone want more information.

As a usability consultant I work with every size and type of company, working as one part of a larger team hired to build, promote and maintain the website. We end up needing to redesign most of the sites because they failed to perform as expected due to not being built properly. I'm also getting more clients who are facing ADA lawsuits from people who are unable to perform tasks on the website. This situation is getting worse because designers don't know how to make accessible websites. I always recommend hiring an agency if the goal is an online business.

(more) I have been building and marketing websites since 1996.  I founded an online community on web design that ran for 20 years. I was one of the pioneers of SEO and today am focused on building websites that can be used by everyone, including disabled persons. Today, it takes a team to build, promote and maintain a website. The skills needed are always changing, which doesn't make it easier for anyone shopping for help.  The first thing is to find a company that you trust will have your best interests in mind - not their's.   A portfolio is meaningless without the data to support it (or they getting traffic? Sales? Is it designed for mobile? Meets ADA compliance?) Today's websites are being served with lawsuits because they are not built for text to speech software, mobile apps or screen readers. Websites must be maintained, monitored, secure. If you want a search engine presence, that is another investment.  I make most of my living fixing broken websites and delivering bad news that a site was not built to meet its business or target market requirements. Find a company that will listen to you. Yes, you will have a budget.  Find a web design/digital marketing agency that has your best interests in mind. Some only take small and medium sized businesses and are devoted to them, while others target corporate sized and charge more - and still end up on my doorstep in need of help.
