How We Got Started

I was approached by a woman who invested all of her savings in a retirement home. She was bilked out of her home by her drug-addicted son, who gave the house to his dealer to pay his debt. My client stood to lose everything. I sued the dealer and got the property put back in my client's name. For all of my career, my primary value has been CLIENT FIRST.

The challenge often does not involve the language barrier.  Rather it involves people from different cultures who do not understand how business in America is conducted.  In many countries, a person's word is his/her bond, and a handshake is enough to make a contract.  American judges don't seem... (more) The challenge often does not involve the language barrier.  Rather it involves people from different cultures who do not understand how business in America is conducted.  In many countries, a person's word is his/her bond, and a handshake is enough to make a contract.  American judges don't seem to understand that, and they prefer written contracts to oral ones.  Some cultures are still misogynistic, and the "old boys network" still prevails.

(more) This issue is evolving.  As I'm sure you're aware, the composition of the United States Supreme Court has dramatically changed over the past 2 years.  Having said that, I don't think the changes in the Court will have any impact on your situation.  Without question, your employer should permit you to observe the Sabbath.   Title VII of the Civil Rights Act of 1964 prohibits employment discrimination based on religion. That prohibition includes refusing to accommodate an employee's sincerely held religious beliefs or practices unless the accommodation would impose an undue hardship.  The courts have said that an undue hardship is more than a minimal burden on the operation of the business.  I hope this helps.

I'm a lawyer.  The IP attorney is right that you can't stop your competitor from adopting your ideas under intellectual property law.  But that isn't the only potentially applicable law.  Also applicable is California's unfair competition law.  That law forbids "unfair, deceptive, untrue, or misleading advertising."  It also prohibits "unfair, or fraudulent business act or practice," although those terms are open to interpretation. Your next question undoubtedly will be what can you do about it.  The good news is that California law expressly authorizes a court to take "whatever action is necessary" to restore you to the position you were in before the violation occurred.  That includes paying your damages. When you say that your competitor posts your "collateral" on his online platforms, I'm not sure what you mean. You say your competitor constantly sends you fake quote requests and does not stop his other nuisance time-killing spying attempts (like multiple phone calls per week). You should seek a restraining order to stop him from doing that. I hope you find this information helpful.
