In general yes as long as they meet the same standards for pre-Covid compensation levels. However you have to show documentation that you offered to hire them at the same location and they rejected the offer
· You must have made an written offer to rehire in good faith (either through email or a physical offer on paper)
· You must have offered to rehire for the same salary/wage and number of hours as before they were laid off
· You must have documentation of the employee’s rejection of the offer (again, email proof is fine, or even better, a written document with the employee’s signature showing they reject the offer.
You won’t be penalized—you can still get your loan 100% forgiven if you follow these guidelines.   The SBA clearly indicates that if some employees don’t want to come to back to work, you can hire others to replace them.
