If you are into branding your image, trademarking is more important. Depending on the state you live in, you may have some of these protections thru the registration process. So for example, in Hawaii, the DCCA doesn't allow businesses to be registered if they have similar names. However, that would carry no federal protection. They are helpful if you are concerned about your business being confused with others. When in doubt, ask an attorney. Find the county bar association for the county you are based in. Ask them for a reduced rate referral with an attorney that specializes in this area.
The issue sounds to be one of communication. If you cannot communicate with your attorney, then it may be appropriate to terminate representation. However, the attorney may have strategic reasons for delay. IMO reach out to them and if they ignore you, then consider other options.
