What an unfortunate nuisance, especially if professionals are telling you that there isn't much you can do about it. Perhaps there is a way to use this to your advantage, advertising yourself as the "original", perhaps somehow creatively showing proof that you thought of it first and this person is a copy? Very similar to Carolyn's suggestion saying "I'm the real deal!" Also as a person exercising genuine ideas, you most likely create an experience for your customers that your competitor can't possibly provide, as their business relies heavily on mimicking your marketing.
I'm slightly joking but maybe release some bad marketing for them to copy and take it down! Again, that was in jest.
Kudos to any legal advice from other people on Alignable! Keep being original, it will show!
Before we opened up the sewing and alterations shop, we had an apparel line with a large company and an apparel development department. This photo was the running joke that we all had hanging in our office!

That was the first reason I started Bespoke Stitchery. I love sewing, I love the process, I love the machines, I love my grandmother for teaching me every skill she knew.
I started in NY as Urban Cowgirl, and sold my wares to boutiques. When I needed a change, I moved my business to FL. In sunny FL I worked (and lived) in a warehouse (that didn't even have a shower in it) and happily peddled at farmer's markets.
Eventually I got a job opportunity to sew toss bags for a sporting goods company. When I saw how they had their sewing department set up, I recognized an immediate need for efficiency. Mind you, the need for efficiency was driven from a more convenient set up for the sewers, I didn't realize that it would benefit the company as a whole the way that it did!
My suggestions quickly followed a promotion to sewing room manager. I loved the job, and all the employees were like family. We made fun products, we were fun people! The fun was inspiring, soon I was creating new products out fo the cut and sew department, and we sold thousands in the first month!!
Things were seasonal there however, and when people weren't ordering our gaming products, we weren't working. This happened around the same time each year (when college and pro sports weren't in season) and the factory would close. It was our love for each other as a work family and perhaps magic that brought us all together again every year, instead of looking for steady jobs.
I couldn't let my family go through this another year, so I suggested outsourcing our cut and sew services to other companies. We grew really big, really fast from this! We went from a sewing staff of 12 sewers to SIXTY sewers, about 20 machines to 80 machines, and a $10M company to a $30M company. I went from sewing manager to COO with over 100 private clients and our own athletic line.
However the fast paced growth quickly introduced far too many moving parts to manage each vertical and focus. It was only smart to separate the sewing company from the sporting company so each company could sustain and maintain healthy growth and progress.
Now I am the CEO of my own cut and sew company, and I run a much smaller staff. Those who journeyed with me all have secure jobs either with me or the sporting company, and many followed their dreams elsewhere.
Its my love for sewing that fueled what I consider major successes in my career path and business!!

When we initially connect with prospects, one of the most important questions we ask is “What is/was the driving force that manifested this product/idea?”
While the specs are important to product development, the “why” is always fascinating to us. When a prospect describes the product they want to build, our favorite part is watching their eyes light up with passion and excitement when we ask what sparked the idea and made them go for it!

We had a local customer with a large order for cutting and sewing an as seen on TV product.
We knew going into production that the volume of the order and the time it would take to cut, sew, QC (quality control) pack and ship would cut into their Amazon fulfillment deadline and we weren’t going to make it.
To make up for time and ensure our client met the deadline, we packed up the order in a few employee cars and personally delivered the order as soon as it was finished.
The one day saved in ship time allowed the customer to meet their fulfillment deadline with Amazon!
We were so thankful we were able to find a time saving solution for the order, and our client felt our actions were above and beyond his expectations!
