The biggest misconception about my particular area of practice is that all cases are alike. How many times have I heard it said that, "my friend's friend got a ticket or a DWI" or similar issue, "and they got a great deal, as compared to what you are telling me is the offer." No two cases are exactly alike. We all have different interactions with law enforcement and the criminal court system. Just because a person says that they got a "great deal" or that their friend got a 'better deal" isn't necessarily true. Most people lie, exaggerate or embellish. Do you honestly think that they are going to tell you the truth?
A good criminal defense attorney will always fight to get their client the best outcome possible; however, a great deal depends on their history and the manner in which they exposed themselves to the police at the time of the incident. If you are a first-timer and respectful, you might get off with a warning. If you are a repeat offender or belligerent to the officer, you will likely have a different outcome. Attitude matters.
Also, your attorney's reputation will also count in their negotiations with the District Attorney's Office. If they are known to be honest and reliable, they will get the benefit of the doubt. If they are not considered to be reliable, then the client doesn't get the break, if one is available.
Likewise, is your attorney proactive in making certain that you have what is necessary to present a favorable side for you? Does he have your reports ready ahead of time? Does he explain the need for "good guy/girl" letters and who they should be coming from?
More goes into representing a client properly than simply just showing up ands looking like a professional.
