Are you sure that you own your business name? File for a dba certificate (Doing-Business-As) with your County Clerk's Office. Cost is minimal. Ask your attorney about the penalties for those that use your business name and focus on utilizing your leverage points as much as possible to discourage competitors. (2). Discuss use of a "Cease and Desist" order with your attorney. (3). Speak with an attorney experienced with copyright, trademark and patent laws. Consider marking your advertisement materials as "Copyright Pending".  (4). Get a distinctive logo for your business and place it on your materials. The use of a "water-mark" may be effective. (5). Promote your business logo, not you. (6). Send a complaint letter to your district attorney's office and include specific information and examples. (7). Follow-Up with your district attorney's office and others as appropriate and be persistent. (8). Consider, including as appropriate a copy of your dba certificate (Doing-Business-As) with all correspondence for attorneys, your printers and advertising material. (9). Complain to any local, state and national industry leadership organizations, Better Business Bureau (also ask your local BBB for advice and suggestions. You may elect to join the BBB. We have found this membership to be very beneficial. (10). Spread the word that you own your business name and the logo is yours. (11). I intended to put this suggestion as Number (1): Get acquainted with a professional and ethical business such as FedEx Office and use some of their printing or other services so that the vendor considers you to be their customer or client. Pose some of your questions to the manager or other experienced person working there and ask about their knowledge or experience about problems similar working with other customers.

Additionally, at the most appropriate time we offer to provide prospective clients contact information for a small number of prior clients.         Another technique we use effectively is to offer to send to selected prospective clients a sample of our product for their review and discussion with business advisors such as partners, consultants and attorneys. This product is a customized written report that costs a purchaser $1,000 and up.
