About Us

Timothy C. Martin is a Florida attorney and a member in good standing of The Florida Bar. He earned a J.D. from Barry University School of Law in Orlando, Florida, and a B.A. from Ohio State University in Columbus, Ohio. Tim is a member of The Florida Bar, Hillsborough County Bar Association (and current co-chair of the Diversity, Equity, and Inclusion Committee), Ferguson-White Inn of Court (and Board of Directors member), and a former member of St. Petersburg Bar Association. He currently serves on the Florida Bar's Diversity & Inclusion Committee and was a fellow of Class IX of the Leadership Academy.

Martin Law Office was formed right after Tim graduated from law school and passed The Florida Bar exam. Martin Law focuses on estate planning and probate, business organizations and contracts, animal law, LGBTQ advocacy, and real property including landlord/tenant matters.

There are many issues to consider when deciding whether in-house or outside counsel is the better choice and it often depends on the circumstances as well as the knowledge/experience of those involved.

My advice is to take a step back and look at the roles - rather than the person. If the role was being performed by a non-family member, would you be asking the same questions or treating that person the same? Notwithstanding the foregoing, if you (as the business owner) need to understand certain things about the tech portion, then explain that to your daughter and develop a general business plan on how you expect to be kept in the loop. It's not micromanaging at that point. Each of you will just be doing your jobs as any other person. If your daughter is making good decisions re tech issues, then treat her just like any other employee. Likewise, if she isn't, still treat her just like everyone else.

However, if your material is more generic, then it will probably be impossible. You should definitely start with a cease and desist letter but it must be specific. If you would like to me review anything, email me your document and what your competitor has done with the same document.

However, with respect to the specific issue regarding the vehicle, why not use AAA or another towing service just to move the vehicle? You would be liable for any damage to her vehicle so it's best to use a professional. Also, review the lease terms. Do you have any provisions in there about vehicles must be operating order? Leases should always anticipate potential issues BEFOREHAND so they can be dealt with easier if/when the time comes.

Unless someone is expecting an urgent call, I believe it is common courtesy to turn cell phones off - or at the very least put them on silent - during meetings. I try very hard to make a positive difference for my clients, and also to keep my fees lower to make legal services affordable. Martin Law Office is also dedicated to providing pro bono legal services to clients who simply could not obtain legal representation otherwise. The other big misconception is about how legal services are provided - it is a collaboration between the attorney and the client who needs to be responsive and involved in the process.
