No lawyer can "withhold" your case from you. How long to wait for a potential settlement depends on the specific facts of your case, whether there is a good chance of settling at mediation or after, and what are your chances at trial.  A case working its way through the litigation / courts can... How long to wait for a potential settlement depends on the specific facts of your case, whether there is a good chance of settling at mediation or after, and what are your chances at trial.  A case working its way through the litigation / courts can take time. I just settled one that took 5 years to resolve, but in the end the client was very happy with the outcome.  IF you believe your lawyer is not progressing the case forward at all, then you could terminate the lawyer for cause and take your case elsewhere.  The terminated attorney and new attorney might have to fight over a fee if they cannot agree on one, but that is not your problem and would not hold up the case.
