You need to consult a lawyer in Indiana since Indiana law will govern the controversy.  If you can prove that the owner was involved in a scheme to have his/her car stolen, you may have a claim for civil conspiracy against the owner as well as a property damage claim against the driver. Mediation yes.  I personally do not like arbitration because it is final and binding and I do not think arbitrators always get things right.  I think it is in the client's best interest to preserve the client's right to appeal a bad decision.
