I had a client that wanted to build with me but had already signed a contract on a lot that I did not have access to. The builder had his deposit for over a year and had not started construction. They liked the location and the builder would not sell him the lot. Finally they asked for their deposit back after 18 months. Turns out the builder had spent it. I spent several months trying to find an equivalent lot in a similar area during this time. When he couldn't get his deposit back he ended up just building with the original builder.
